Well the big boss came in and the Forklift Operator told him that his boss instructed him to wait, and nope, the CEO ordered him to start moving it NOW! (He was furious, understandably, due to OSHA violations.) He refused, then the CEO threatened to fire him, other employees told him the Boss is on the other side, he’s evaluating the… it didn’t matter, he ordered him NOW or you’re fired! So he proceeded, that was when all the stuff came collapsing down.

He was in critical condition and was flown to a Level 4 Hospital. His wife phoned me because she was totally distraught! She was bedridden (due to a bad fall, she was returned home with the Hospital bed and had Nurses come twice a day, her spine had been “screwed together” and a couple of pins) and wasn’t able to meet up with her husband at Level 4 Hospital way over the other side of the bay. I then met up with her, she was truly believing her husband was killed. I assured her I will personally phone to get more information.

Unless something extreme happened (such as you wound up in hospital with major surgery, plus rehab, etc - or in one case, my congregation member wound up being wedged between the wall and all the contents on the top shelf that toppled over him which he was now disabled waist down and had to have pins all over his body), all one would need to do is provide the court “why the delay”. The Judge can make an “exceptions ruling”.
As for the Judge, the accident citation was “postponed” - it could not be eliminated because he was at fault, however, instead of a warrant for his arrest, he was permitted to pay the fine at a later date due to nature of circumstances. He paid the fine as a whole, and the court refunded him $150, half of the fine amount, because the Judge reduced the amount. Interestingly enough, there were no points placed in because of “statue of limitations” expired.

Thankfully the Lawyer had the recorder (small tape cassette) and the line was recorded and he took out a small digital camera and took the photo of the Caller ID.

When I came to the Secretary’s Office, I told her, provided her the originals which she made copies of, and the Highway Patrol and First City Police Officer case numbers, and then the Court Warrant, the Officers case number.

The Fire Lieutenant called for the Police, the CEO was arrested for “endangerment of a human being” with more charges pending and the OSHA was also alerted.
As I headed to get into my truck, he came running and slipped me a business card and said “Give this card to them please and you didn’t get it from me.” I said “Okay”, placed it on top of what he had given me before that; and drove off to meet him at the Level 4 Hospital.

All in all, over the period of trying months, her husband came home, and she was now able to move around with a little assistance, just able to walk and get up and down on the toilet, could take a shower on the shower seat. Apparently the children came home, and we could hear the Police officer explaining that daddy got hurt at work, and mommy needs you to dial this Hospital number and I notice you have a speaker phone, to put the phone here and put the speaker phone on so they can talk. Daddy was in surgery right now. The Nurse was trying to relay the message ‘HAVE MOMMY CALL ME! I had to phone my parents to pick up my son from school or home, if he wasn’t at school. To take him home with them because I had no idea how long it would be before I got out of the hospital, it could be a long one. I then explained to my dad what happened, and he told me to stay put, and made a comment “they should hire a real good lawyer and sue them!”
For another 5 hours, finally he was out of surgery (he was in surgery for almost 6 hours), it was 100% success, he was now in recovery, heavily sedated. The Surgeon told me, if he had been there for another 30 minutes, he wouldn’t have made it! Told me what he did and what he done, and another Surgeon had to repair a couple of organs (tear, internal bleeding). He would be moved to the CCU for observation for 2 days, then move down to ICU for awhile, then to a Semi-ICU for a short time before moving to a regular room. The Surgeon then suggested it would be a good idea if I was with her, that was until I told him “She’s bedridden, due to surgery and medical”. He then acquired her landline number and I gave him the best times to call, because I knew when the Nurses were there and when the kids would be home. He gave me his personal mobile phone number to give to her.

Once she signed the documents, I then told her upfront, if she could remember the phone call? When I summoned him over to answer it? She said yes, and it was probably a Sales Call. I was not aware of a speeding ticket (which he gotten earlier before this incident), he was court ordered to appear in court, and he didn’t show up (well, he was in hospital and they had to re-break a couple of his bones so it could be set and heal properly); he was kept in the “Semi-ICU” unit where he was completely immobilized.
